Terms and Conditions

Last updated:

August 5, 2026

These Terms and Conditions are the agreement between you and Garner Legal LLC that governs your use of garnerlegalutah.com (the "Site"). They set out the rules for using the Site, who owns what appears on it, and how any dispute about the Site is handled. Read them before you use the Site. If you do not agree to them, please do not use the Site.

Accepting These Terms

By visiting or using the Site, you accept these Terms and Conditions and agree to be bound by them. If you use the Site on behalf of a business or another person, you confirm you have the authority to accept these terms for them. These terms apply every time you use the Site, so if they change, the version in effect is the one posted here when you visit.

What These Terms Cover

These terms govern your use of the Site itself. Two related topics are handled on their own pages so you can find them easily. How this Site treats legal information, and why using it does not create an attorney-client relationship, is explained in our Legal Disclaimer. How the firm collects and handles information submitted through the Site is explained in our Privacy Policy. Both are part of the terms that apply when you use the Site.

Who May Use the Site

This Site is intended for adults who are dealing with, or looking into, a legal matter in Utah. It is not directed to children, and it is not intended for use where doing so would violate the law. By using the Site, you confirm you are old enough to enter this agreement and that your use of the Site is lawful where you are.

Rules for Using the Site

You may use the Site for your own lawful, personal purposes, such as learning about the firm and reaching out about a matter. So that the Site stays useful and secure for everyone, you agree not to:

If you misuse the Site, the firm may restrict or block your access without notice.

Messages and Form Submissions

When you send a message through the contact or intake form, you are responsible for what you submit, and you agree that the information is accurate to the best of your knowledge. Sending a message does not obligate the firm to respond, to take your matter, or to keep the information confidential before an attorney-client relationship exists. Please send only what is needed for the firm to see whether it can help, and hold sensitive material until the firm has agreed in writing to represent you. The details of why are on the Legal Disclaimer page.

Intellectual Property and Permitted Use of Content

The text, design, layout, and other material on this Site belong to Garner Legal LLC or its licensors and are protected by intellectual property law. You may view the Site and print or save individual pages for your own reference, and you may link to the Site. You may not republish, sell, or reproduce substantial parts of the Site, or present its content as your own, without the firm's written permission. The name "Garner Legal LLC" and the firm's branding identify this firm and may not be used in a way that suggests an association or endorsement that does not exist.

Availability and Changes to the Site

The firm maintains this Site as an informational resource and may change, suspend, or remove any part of it at any time without notice. The firm does not promise the Site will always be available, uninterrupted, or free of errors, and it may update content as the law and the practice change. The firm is not responsible to you if the Site is unavailable at any particular time.

"As Is" Basis and Limitation of Liability

The Site is provided on an "as is" and "as available" basis, without warranties of any kind, express or implied. To the fullest extent allowed by law, Garner Legal LLC and David R. Garner are not liable for any loss or damage arising from your use of, or inability to use, the Site or anything on it, including any direct, indirect, incidental, or consequential loss. You use the Site at your own risk.

Governing Law and Where Disputes Are Heard

These Terms and Conditions are governed by the laws of the State of Utah, without regard to conflict-of-law rules. Any dispute arising out of or relating to these terms or your use of the Site will be brought only in the state courts located in Davis County, Utah, or in the United States District Court for the District of Utah, and you agree to the jurisdiction of those courts.

If Part of These Terms Cannot Be Enforced

If any part of these Terms and Conditions is found to be unenforceable, the rest stays in effect. The firm's decision not to enforce a term on one occasion does not waive its right to enforce it later. Together with the Legal Disclaimer and Privacy Policy, these terms are the entire agreement between you and Garner Legal LLC about your use of the Site.

Changes to These Terms

The firm may update these Terms and Conditions from time to time. The version posted here, with the date shown above, is the one in effect, and any change takes effect once it is posted. Continuing to use the Site after a change means you accept the updated terms, so it is worth checking this page when you return.
