When Should You Talk to a Litigation Attorney?
Litigation is the process of resolving legal disputes when negotiation alone isn't enough. While many cases settle before trial, effective litigation begins long before anyone enters a courtroom through careful investigation, legal analysis, and strategic preparation.
Most people wait until a lawsuit lands on their desk. But the earliest decisions are often the most important ones. Talking to a litigation attorney before positions harden can preserve evidence, protect your rights, and open doors to resolving a dispute before it grows more costly and more painful.
You're caught in a trust, probate, or inheritance dispute and aren't sure what you're entitled to.
You're a trustee or personal representative accused of doing something wrong while trying to do the right thing.
Your business received a demand, a lawsuit, or a UALD charge.
A former employee has filed a claim, or an internal complaint needs investigating.
A partnership, contract, or trade secret dispute is threatening your business.
You're an insurer or an insured facing a liability or coverage fight.
If any of this sounds like your situation, let's talk it through and see where you stand.
A Litigation Attorney Who Actually Litigates
Many firms in Kaysville draft documents and handle a little of everything. I built Garner Legal LLC for a different purpose: contested matters. Courtroom disputes aren't just one of my practice areas; they're the foundation of my practice. That focus means your case benefits from an attorney whose practice is built around strategic advocacy, motion practice, negotiations, and trial work, not one who handles litigation only occasionally.
I chose this area of law because I enjoy solving complex legal problems and building thoughtful strategies for difficult disputes. Because Garner Legal LLC is my practice, I stay closely involved in every stage of your case. From developing strategy to appearing in court, you'll always know who's responsible for moving your matter forward.
“I wanted to make a meaningful difference in the lives of my clients and the community I serve. After working at one of the largest firms in the country, I wanted to move beyond the layers of bureaucracy and build a practice where I could work directly with my clients, understand their needs, and focus on achieving the best possible outcomes for them.”

Meet David R. Garner
David founded Garner Legal LLC after a decade litigating at respected regional and national firms, including one of the largest in the country.
David's practice is intentionally focused. Rather than handling every type of legal issue, he concentrates on contested matters where strategic thinking, careful preparation, and courtroom experience make the greatest difference.
Since beginning his legal career in 2016, David has represented individuals, businesses, employers, trustees, personal representatives, insureds, and insurance carriers in complex litigation across state and federal courts. He earned his J.D. cum laude, served as Production Editor of the Kentucky Law Journal, and holds a B.S. in Mathematics Education from Brigham Young University. An Eagle Scout who speaks Cambodian, David spends his time outside the courtroom with his wife and children, hiking, golfing, and enjoying the community he calls home.

Common Questions
Frequently Asked Questions About Litigation in Kaysville
This is general information, not legal advice.
What does a Kaysville litigation attorney do?
A litigation attorney helps individuals and businesses resolve legal disputes through negotiation, motion practice, mediation, or trial when necessary. I focus on trust and estate litigation, employer-side employment law, business litigation, and insurance defense.
Do I work directly with David Garner?
Yes. I personally handle your matter from consultation through resolution, providing consistent guidance and advocacy throughout the case.
Do you represent employees?
I represent employers in employment matters, including UALD investigations, workplace investigations, and employment litigation. Restrictive covenant matters may be handled on a side-neutral basis.
Do you handle estate planning or will drafting?
No. I focus on litigation: disputes involving trusts, estates, probate, and fiduciary issues, not drafting.
Do you handle divorce or family law?
No. Garner Legal LLC does not handle divorce, family law, child custody, or guardianship matters.
When should I contact a litigation attorney?
As early as possible. Early guidance can help preserve evidence, clarify your rights, and prevent decisions that make a dispute harder to resolve later.
How long do I have to contest a trust in Utah?
It depends on the type of challenge, and the deadlines are governed by the Utah Uniform Trust Code and Uniform Probate Code (Title 75). Some deadlines shorten significantly once a trustee sends formal notice, and missing one can bar your claim entirely, so it's worth talking to an attorney quickly.
Can an employer enforce a non-compete in Utah?
Utah employers can generally enforce reasonable restrictive covenants, though Utah law limits many post-employment non-competes to one year, and courts scrutinize the scope, duration, and geographic reach. Whether a specific agreement holds up depends on how it's drafted and enforced.
The Earlier We Talk, the More Options You May Have
Many legal disputes become more expensive and more difficult to resolve because early decisions are made without experienced legal guidance. Even if you're unsure whether you have a case, an early conversation can help you understand your options before the dispute gains momentum. At Garner Legal LLC, you'll get direct representation from an experienced Kaysville litigation attorney who takes the time to understand what's at stake for you.
You don't have to face it alone. Let's take the first step together.
